Child Safety and Use of Corporal Punishment in Schools

The superintendent wrote, “Your repeated use of physical force was completely unwarranted and unprofessional.” (http://fox2now.com/2014/05/15/caught-on-camera-teacher-grabs-kindergartener-by-the-face/)

After an Ohio teacher was caught under surveillance cameras, she picked up 6 year old Lan Nelson and constraints him to the wall. Cameras also show, the Kindergarten teacher clutching on to his face. Force and restraints were overseen, that baffled many parents and facility in the state of Ohio.

According to Department of Education of the United States, Summary of Seclusion and Restraint Statues, Regulations, Policies and Guidance, by State and Territory: Information as Reported to the Regional Comprehensive Centers and Gathered From Other Sources, Ohio state policy implies,

a. “Transitional hold my be applied only by staff with current training on the safe use of this procedure, including how to recognize and respond to signs of distress in the individual;

b. “Transitional hold by be applied only in a manner that does not compromise breathing, including the compromise that occurs with the use of:

(1) pressure or weight bearing on the back;
(2) soft devices such as pillows under an individual’s face or upper body; or
(3) the placing of an individual’s or staff’s arms under the individual’s head, face, or upper body;

 c. “Transitional hold may be applied only for the reasonable amount of time necessary to safely bring the person or situation under control and to ensure the safety of the individuals involved; and

d. “Transitional hold may be applied only with consistent and frequent monitoring during and after the intervention with every intent to assure that the person is safe and suffers no harm.” (Duncan, 2010, p. 164)

While charges and court dates are being lined in order, deputies and investigators are unaware of why Ms. Williams allowed herself to release such aggression on her student, but Lan and his family are yearning for unanswered questions, as well as dispensing emotions and sorrow.
